Terms of Service

1. Agreement to Terms
By accessing, browsing, registering an account on, or otherwise using Sky Index (the "Service"), operated by Fleet 22 (a sole proprietorship registered in Ontario, Canada, herein referred to as "Fleet 22," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations of Canada and your jurisdiction. If you do not agree with any part of these Terms, you must not access or use the Service. Your use of the Service constitutes your express acceptance of these Terms in their entirety.
These Terms apply to all visitors, registered users, contributors, and subscribers, regardless of whether you have a paid subscription. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Service Description
Sky Index is a community-driven aviation platform providing reference data, personal logging tools, community features, and AI-powered identification tools for aviation enthusiasts, spotters, pilots, builders, and historians. The Service includes the following features:
- Aviation Database: Aircraft types, airframes (serial number records), registrations, operators and airlines, airports and facilities, spotting locations, preserved aircraft, and aviation events — sourced from community contributions, public records, and third-party datasets.
- Flight Log: Personal flight tracking tool for logging flights you have taken, including aircraft, route, airline, seat, cabin class, and notes. Private by default with optional per-entry public sharing.
- Sighting Log: Personal aircraft spotting log for recording sightings, including date, time, location, movement type, aircraft, and operator. Private by default with optional per-entry public sharing.
- Aircraft Identifier: AI-powered image analysis tool that attempts to identify aircraft type, registration, and operator from uploaded photographs. Provided for hobbyist and educational reference only.
- Community Groups: User-created and user-managed groups for pilots, spotters, homebuilders, airline enthusiasts, warbird groups, helicopter groups, glider groups, and other aviation communities, including discussion posts, questions, announcements, photos, events, and for-sale listings within groups.
- Build Projects & Build Logs: Public project pages for homebuilt aircraft, restorations, RC models, simulator builds, warbird restorations, and other aviation projects with updateable build logs, hour tracking, and milestone markers.
- Aviation Q&A: A community question-and-answer board for aviation-related questions on any topic.
- Photo Contests: Community aviation photography competitions with themes, time-limited entry periods, and community voting.
- Airport Check-ins: Voluntary, public check-ins at airports and facilities, including visit type, aircraft spotted, and optional notes.
- Aviation Marketplace: A community-moderated listing board for aviation parts, avionics, tools, models, books, apparel, aircraft for sale, services, and related items. Sky Index does not facilitate, broker, guarantee, or accept liability for any transaction between users.
- Wishlist / Saved Items: Personal lists of airports, aircraft, events, registrations, and routes to save for later. Private and visible only to you.
- Favorites & Following: Save aircraft types, airports, registrations, airframes, operators, and other entities; follow users and build projects.
- Direct Messaging: User-to-user private messaging within the platform using your email address and display name.
- Achievements, Badges & Leaderboard: Gamification features recognising contributions, milestones, and community participation.
- User Profiles: Public profile pages displaying your contributions, activity, achievements, and optional biography, location, interests, favourite aircraft type, home airport, equipment used, website, and social links, organised into tabs (Photos, Sightings, Flights, Check-ins, Achievements, and About).
- User Dashboard: A private account dashboard summarising your recent sightings, flights, photos, favorites, achievements, messages, and upcoming events, and allowing you to edit your profile.
- Activity Feed: A personalised feed showing recent public photos, sightings, flights, check-ins, achievements, and group posts from users you follow.
- Photo Uploads: Community photo contributions linked to aircraft types, airframes, registrations, operators, facilities, events, and sighting logs.
- Suggest & Contribute: Submit additions, corrections, or edits to the database for admin review before publication.
- Operators & Airlines Database: Browse and search airlines, cargo operators, military operators, government operators, charter companies, helicopter operators, and other aviation operators with IATA/ICAO codes, callsigns, and fleet information.
- Maps: Interactive maps of airports, preserved aircraft locations, and spotting activity.
3. Eligibility and Age Requirements
You must be at least 13 years of age to create an account and use personalised features of Sky Index. By registering an account, you represent and warrant that you meet this age requirement. Users under 18 years of age should use the Service only with the involvement and consent of a parent or legal guardian. Parents or guardians are responsible for monitoring their children's use of the Service.
Fleet 22 does not knowingly collect, store, or process personal information from children under 13 years of age. If we learn that we have collected personal information from a child under 13, we will delete that information as soon as practicable. If you believe a child under 13 has provided us with personal information, please contact us immediately at fleet22co@gmail.com.
You must have the legal capacity to enter into a binding agreement under applicable law. You may not use the Service if you have been previously banned or suspended from the Service.
4. User Accounts and Registration
To access personalised features — including flight logs, sighting logs, groups, build projects, direct messaging, check-ins, favorites, wishlists, and subscriptions — you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information for your account;
- Maintain the confidentiality of your login credentials and account access;
- Accept responsibility for all activities that occur under your account, whether authorised by you or not;
- Notify Fleet 22 immediately at fleet22co@gmail.com if you become aware of any unauthorised access to or use of your account;
- Keep your account information up to date and accurate.
You may not: create accounts on behalf of other persons without their authorisation; create multiple accounts to circumvent a ban, suspension, or moderation action; share your account credentials with others; or use another user's account.
Fleet 22 reserves the right to suspend or terminate any account that violates these Terms, that engages in fraudulent or unlawful activity, or that creates a risk of legal liability or harm to other users or the Service.
5. User-Generated Content
You are solely responsible for all content you submit, post, upload, or otherwise contribute to Sky Index. "Content" includes, without limitation: photos and images, flight logs, sighting logs, group posts and comments, build project updates and build logs, Q&A questions and answers, contest entries, marketplace listings, check-ins, profile information and biographies, direct messages, wishlist items, favorites, and all aviation, facility, operator, and aircraft data contributions, corrections, or suggestions.
By submitting any Content to the Service, you grant Fleet 22 a worldwide, perpetual, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, display, distribute, and otherwise exploit that Content solely for the purpose of operating, providing, maintaining, improving, and promoting the Service and its features. This licence survives the termination of your account.
You represent and warrant that: (a) you own or otherwise have the necessary rights to all Content you submit; (b) your Content does not and will not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, publicity rights, contractual rights, or any other rights; (c) your Content is accurate to the best of your knowledge; (d) your Content complies with these Terms and all applicable laws; and (e) you have obtained all necessary consents, releases, and permissions from any persons depicted or identifiable in your Content, and from the copyright holders of any included materials.
Fleet 22 does not claim ownership of your Content. However, the licence you grant allows us to display and use your Content as described above. You may request removal of your Content at any time by contacting us, subject to our retention obligations under applicable law.
6. Photo and Image Submissions
When you upload photos to Sky Index, you confirm that: (a) you are the original photographer or have written authorisation from the copyright holder; (b) the photo does not violate any third party's copyright, privacy, or other rights; (c) the photo does not contain sensitive, classified, or legally restricted subject matter; and (d) you have obtained permission from any identifiable persons depicted.
Photos that include aircraft registrations, military serial numbers, or facility locations should not reveal sensitive or restricted security information. Do not upload photos taken in areas where photography is prohibited by law or signage.
Fleet 22 reserves the right to remove any photo at its discretion, including photos that are blurry, low-quality, misleading, duplicate, or that violate these Terms. Approved photos may be featured as cover images on linked entity pages, and each photo is assigned its own permanent, publicly indexable page on the Service unless marked private.
Photo Visibility and Permissions: From your photo management dashboard, you may mark individual photos as public or private. Private photos are visible only to you and are excluded from public galleries, entity pages, and search indexing. You may also control whether other users are permitted to download your photo, and you may optionally apply a Sky Index watermark to the publicly displayed version of your photo. Applying a watermark does not transfer or alter ownership of your Content, and you may remove the watermark at any time via your photo settings.
Downloading Photos: Where a photographer has enabled downloads for a photo, a download option is displayed on that photo and other users may download a copy of the publicly displayed (possibly watermarked) image for personal, non-commercial use only. Downloading a photo does not grant any licence to reproduce, redistribute, sell, sublicense, or use the image for commercial purposes, and the original photographer retains full copyright and ownership at all times. Any further use of a downloaded photo requires the express permission of the photographer, and attribution to the photographer must be preserved wherever the photo is reused with permission.
7. Community Features — Groups, Q&A, and Build Projects
Community Groups, Q&A boards, and Build Project pages are user-created and user-managed spaces. Group creators and project authors are responsible for managing their own spaces, including moderating posts and comments within their groups and projects.
Fleet 22 is not responsible for the content posted in these community spaces and does not pre-screen user-generated content. However, we reserve the right — but not the obligation — to review, edit, remove, or hide any group, post, comment, build log, Q&A entry, or other content that we believe violates these Terms, is objectionable, or may expose us or other users to legal liability. We may take action without notice and at our sole discretion.
Group administrators and moderators have the ability to manage posts and members within their groups. If you encounter content you believe violates these Terms, please report it to fleet22co@gmail.com.
8. Marketplace Listings
Sky Index does not participate in, broker, facilitate, guarantee, or accept any liability for any transaction between users. The Marketplace is provided solely as a listing board for aviation-related items. Fleet 22 is not a party to any transaction between buyers and sellers.
All listings are subject to moderation and admin approval before appearing publicly. Fleet 22 reserves the right to reject or remove any listing at its discretion, including listings that are incomplete, misleading, prohibited, or that violate these Terms or applicable law.
You are solely responsible for: (a) verifying the accuracy, condition, and legitimacy of any listing before engaging in a transaction; (b) complying with all applicable laws, including consumer protection laws, export controls, aviation regulations, and tax obligations; (c) ensuring that listed items are legal to sell and possess in your jurisdiction; and (d) conducting transactions safely and at your own risk.
Fleet 22 does not provide escrow, payment processing, dispute resolution, or buyer/seller protection for marketplace transactions. Any dispute must be resolved directly between the parties. Items prohibited from listing include, without limitation: firearms, explosives, controlled substances, stolen property, counterfeit goods, classified or restricted military equipment, and any items prohibited by law.
9. Photo Contests
By submitting an entry to a photo contest on Sky Index, you confirm that: (a) you are the original photographer and sole copyright holder of the submitted photograph; (b) the photograph has not been AI-generated or substantially altered in a way that misrepresents the subject; (c) the photograph was taken during the contest period unless otherwise stated; and (d) the photograph complies with all contest rules and these Terms.
Contest entries may be displayed publicly on the Service for the purposes of the contest, including voting and result announcements. Fleet 22 reserves the right to disqualify any entry that violates contest rules, these Terms, or applicable law. Contest decisions made by Fleet 22 are final and not subject to appeal.
Voting is community-driven. Fleet 22 may implement measures to detect and prevent fraudulent or automated voting. Entries found to have received fraudulent votes may be disqualified.
10. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable local, provincial, state, national, or international law or regulation;
- Submit, post, or transmit false, misleading, defamatory, libellous, slanderous, hateful, threatening, harassing, abusive, or otherwise objectionable content;
- Stalk, harass, bully, intimidate, or demean any person, including other users, aviation professionals, or public figures;
- Distribute spam, unsolicited commercial messages, chain letters, or phishing attempts;
- Post fraudulent, misleading, or deceptive marketplace listings;
- Use automated tools, bots, scrapers, crawlers, or scripts to access, collect, harvest, or extract data from the Service without express written permission from Fleet 22;
- Use the Service's content or data to train, develop, or improve artificial intelligence, machine learning, or similar models without express written permission;
- Upload or transmit viruses, malware, ransomware, spyware, or any other malicious or harmful code;
- Impersonate another person, organisation, or entity, or misrepresent your affiliation;
- Circumvent or attempt to circumvent any ban, suspension, moderation action, or technical restriction;
- Share, post, or distribute another user's private information (including email addresses, physical addresses, phone numbers, or other identifying information) without their express consent;
- Infringe upon or violate the intellectual property rights, privacy rights, or any other rights of any person or entity;
- Encourage or provide instructions for illegal activity, including but not limited to trespassing onto restricted airport property, breaching aviation security, or violating airspace regulations;
- Post content that depicts or promotes violence, self-harm, or illegal acts;
- Post content that sexualises minors, or that contains child exploitation material, which will be reported to law enforcement;
- Interfere with, disrupt, or overload the Service's servers, networks, or infrastructure;
- Attempt to gain unauthorised access to the Service, other user accounts, or any systems or networks connected to the Service;
- Use the Service for any commercial purpose not expressly authorised by these Terms, including advertising or promoting products or services without permission.
Violations of this Acceptable Use Policy may result in immediate account suspension or termination, content removal, and reporting to relevant authorities.
11. Data Accuracy Disclaimer
Sky Index is a community-driven platform that relies on user contributions and publicly available sources. Fleet 22 makes no warranty or representation regarding the accuracy, completeness, timeliness, reliability, or correctness of any information on the Service. Information may contain errors, omissions, or outdated data.
Aviation data — including aircraft types, airframe histories, registration details, operator information, airport codes, and aircraft specifications — may be incomplete or inaccurate. Fleet 22 does not verify every submission and does not guarantee data integrity.
The Aircraft Identifier feature provides AI-generated identification suggestions for hobbyist and educational reference only. It must not be relied upon for any safety-critical, legal, regulatory, official, or operational aviation purpose. Always consult official sources and qualified professionals for aviation-related decisions.
12. AI and Automated Features
The Aircraft Identifier and other AI-powered features on Sky Index use third-party AI services, which may include Google Gemini, OpenAI, or Anthropic models. By using these features, you consent to your uploaded images and input data being transmitted to and processed by these third-party services.
AI-generated results may be inaccurate, incomplete, or misleading. Fleet 22 does not guarantee the accuracy or reliability of any AI-generated output and disclaims all liability for decisions made based on such output. You are responsible for independently verifying all AI-generated information.
Uploaded images used for AI identification are not permanently stored on Sky Index servers but may be retained by third-party AI providers in accordance with their own data retention policies. Do not upload images containing classified, restricted, or sensitive subject matter.
13. Subscriptions and Payments
Sky Index offers an optional premium subscription ("Sky Index Pro") with enhanced features. Subscription plans and pricing are as follows:
- Sky Index Pro — Monthly: $4.99 USD per month
- Sky Index Pro — Annual: $39.99 USD per year
Payments are processed by Stripe, Inc., a third-party payment processor. By purchasing a subscription, you authorise Stripe to charge your selected payment method. Fleet 22 does not store your full payment card details — these are handled entirely by Stripe in accordance with their security standards.
Subscriptions automatically renew at the end of each billing cycle (monthly or annually) until cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date.
Refund Policy: All subscription payments are generally non-refundable. If you believe you have been charged in error, contact fleet22co@gmail.com within 14 days of the charge, and we will review your request on a case-by-case basis. Applicable statutory consumer rights in your jurisdiction are not affected.
Fleet 22 reserves the right to change subscription pricing upon reasonable notice. Price changes will take effect at the start of your next billing cycle following the notice period.
14. Commercial Electronic Messages (CASL Compliance)
Fleet 22 complies with Canada's Anti-Spam Legislation (CASL). We only send commercial electronic messages (including emails, push notifications, or other electronic communications of a commercial nature) where we have your express or implied consent.
Transactional and account-related messages (such as password resets, security alerts, submission status updates, and payment confirmations) are not considered commercial electronic messages and may be sent without additional consent, as they are necessary to operate the Service.
You may unsubscribe from optional commercial communications at any time by: (a) using the unsubscribe link included in any commercial email; (b) adjusting your notification settings in your account; or (c) contacting fleet22co@gmail.com. Unsubscribe requests will be processed within 10 business days.
15. Intellectual Property Rights
The Service, including its design, features, functionality, database structure, code, graphics, logos, and interface (excluding user-generated Content), is the intellectual property of Fleet 22 and is protected by Canadian and international copyright, trademark, and other laws.
You may not: copy, modify, distribute, reverse engineer, decompile, or create derivative works of the Service; use Fleet 22's trademarks, logos, or branding without written permission; or remove or alter any copyright, trademark, or other proprietary notices from the Service.
Aviation data sourced from public records (such as ICAO, IATA, FAA, or government registries) remains subject to the terms and conditions of those sources. Fleet 22 makes no claim of ownership over such public domain data.
If you believe your intellectual property rights have been infringed by content on the Service, please submit a notice to fleet22co@gmail.com with: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorised; and (e) a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the rights holder.
16. Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the fullest extent permitted by applicable law, Fleet 22, its operators, contractors, and affiliates shall not be liable for any: (a) indirect, incidental, special, consequential, exemplary, or punitive damages; (b) loss of profits, data, goodwill, or other intangible losses; (c) damages for loss or corruption of data; (d) damages resulting from reliance on information obtained from the Service; (e) damages resulting from interactions with other users, including marketplace transactions; (f) damages resulting from AI-generated identification results; or (g) damages arising from unauthorised access to your account.
Fleet 22's total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you have paid to Fleet 22 in the twelve (12) months preceding the event giving rise to the claim, or fifty Canadian dollars (CAD $50), whichever is greater.
You acknowledge that the limitations of liability and disclaimers of warranty in this section are a fundamental basis of the bargain between you and Fleet 22, and that the Service would not be provided without such limitations.
17. Indemnification
You agree to indemnify, defend, and hold harmless Fleet 22, its operators, contractors, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; (d) any Content you submit to the Service; or (e) your interactions with other users, including marketplace transactions.
18. Account Suspension and Termination
Fleet 22 reserves the right to suspend, restrict, or terminate your account and access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms, engaged in unlawful activity, or posed a risk to the Service or other users.
Upon termination, your right to use the Service ceases immediately. Content you have submitted may remain on the Service subject to the licence you granted. You may request deletion of your Content, subject to our retention obligations under applicable law.
If your account is terminated due to violations of these Terms, you may not create a new account. Circumventing a ban or suspension may result in permanent IP-level restrictions and may be reported to relevant authorities.
You may delete your account at any time by contacting fleet22co@gmail.com. Account deletion will remove your profile and personal data, but your public contributions (such as database entries, photos, and group posts) may be retained as part of the Service's permanent record.
19. Third-Party Links and Services
The Service may contain links to third-party websites, services, and resources that are not owned or controlled by Fleet 22. Fleet 22 is not responsible for the content, accuracy, privacy practices, or availability of any third-party websites or services. You access third-party websites at your own risk.
The Service integrates with third-party services including payment processing (Stripe), AI services (Google Gemini, OpenAI, Anthropic), mapping services, and image hosting. Your use of these third-party services is subject to their respective terms of service and privacy policies.
20. Disclaimers
Fleet 22 does not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) any information on the Service is accurate, reliable, or complete; (c) defects or errors will be corrected; or (d) the Service is free of viruses or other harmful components.
The Service is provided for informational and community purposes only and is not intended for any official, safety-critical, regulatory, or operational aviation use. Always consult official aviation authorities, qualified professionals, and certified data sources for any aviation-related decisions.
21. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict-of-law principles.
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to mediation in Ontario, Canada. If mediation fails, the dispute shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
You and Fleet 22 agree that any claim, cause of action, or dispute must be filed within one (1) year after the claim arose, or it is permanently barred.
22. Changes to These Terms
Fleet 22 reserves the right to modify or update these Terms at any time. Material changes will be posted on the Service with an updated "Last updated" date. For significant changes affecting user rights or obligations, we will endeavour to provide notice through the Service or via email to registered users.
Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service and may request account deletion.
23. Severability
If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.
24. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or guidelines referenced herein, constitute the entire agreement between you and Fleet 22 regarding your use of the Service, and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.
